First off, let me say that my fault in this was allowing my excitement in possibly completing a portion of my Want List and having some for my Trade List without fully checking the quantity of packages in a box of cards I purchased from Ebay seller dcards. His original ad didn't show a quantity so I sent him an email asking about it and he told me it had 100 cards. I had checked all the pictures and details he'd written about the item and nothing was there. I cannot recall if I checked previously sold items like I normally would. If I had I may or may not have purchased this, that's hard to say at this point.
Secondly, I don't mean to disparage the seller as I am giving him the benefit of the doubt that he may have responded initially without really knowing. However, his response to me since the purchase has upset me so that I feel compelled that I must divulge this situation in case you were to seek to purchase from him. I will include the emails we exchanged from the outset until this mornings. They are from two different sources because I used the Ebay Contact tools to initiate them rather than continue on the original contact. Again, that was my fault.
And lastly, before I reveal the situation, I have officially filed a claim to seek a partial refund because as I told the seller, I like the product, I just don't like that he misled me on the quantity I was buying. The number of cards was 1/4 what he told me prior to purchasing, and I'm requesting a 1/3 refund ($5.00).
Now the item and the emails.

Notice the ad doesn't reflect an amount included. (He's selling another box using the same pictures - nothing wrong with that - but he added "FULL 24 COUNT BOX" to his current ad.)

do what you do. you got a great deal. period. the box said 24 ct... cant fit 100 in the box. send back complete unopened. if you opened the unopened packs, then you bought them. 5 dollars, really.

I don't want a full refund. I just want $5.00 refunded. I opened the box and started opening the packages when I realized it didn't hold 100 cards, so I cannot return it unopened even if I wanted to. I collect cards, and some of those I purchased I want, the others I'll keep and try to trade. I just believe you misled me on the purchase. I'll give you one more chance to agree to a partial refund or I'll have to report this to Ebay.

I am a collector and was able to get most of the cards on my Want List from this purchase, however, I was misled by your response since the box actually only had 24 packs in it. I would have countered your offer if I'd known it wasn't for 100 packs as stated in your email below. I would like for you to consider making right on this by refunding me $5.00 on the purchase, and then we can close the book on this.

Again, I have my fault in this, and I don't believe I'm being unreasonable. I feel I've owned up to my mistake and am trying to come to a mutual agreement on a sale that was misleading. The guy would still get his money. Nevertheless I will avoid dealing with dcards again.

The more I read about the ebay shennanigans people report here, the happier I am that I never deal on ebay anymore. I know there are good sellers on ebay but there are too many unprofessional sellers. Ebay when it first started was a really good thing; now I think it is more "Buyer Beware".

Yeah, this is my first issue, actually second, but that first one was entirely my fault and I got a card I needed. In that case I didn't read the entire description and instead of cards, I was bidding on a card.
This one had an element of inadvertent deception at first, then downright refusal to make right on his part.

100 of those 3D cards for $15 is 15¢ a card. That's about right in my opinion of those 3D cards.
I personally don't like them; impossible to store and protect. I think the couple I purchased ended up in the trash.

The seller made a mistake when they claimed the box had 100 packs. Or they made a misleading statement, hoping to make a sale. I don't know their intention.
Their claim that if you opened the product, they are clear of the transaction is a cop out. How would you ever know it was less than 100 packs if you didn't open it? That would be the only way to know that the box does not contain 100 packs.
You received 25% of what was promised. You have to take in account that shipping was free (included in the price ). I'm going to estimate that the shipping for something like that would be around $5. So, approximately $10 for the actual product. You should be asking for $7.50 back. The fact that you're only asking for 50% of the product price when you only received 25% of what was stated clearly in their message to you is very generous on your part. If I walked into a card shop and saw them for $5 for the box, I would think that is a fair price for the product. $2.50 would be on the low side. $10 would seem a little high, but all things considered, it still less than 42 cents per pack. All this is considering 24 packs in a box.
Honestly, I think you have a case where the seller told you one thing and delivered less than told. If you had not asked and not been told 100 packs, you'd have no case.

non-card related but a very bad experience I had happen to me..
I sell queen ants to people... I know odd... but I sold this guy some in China ($2300.00) worth so so a great sale... I do have a policy that if more than X amount do not make the trip i will refund the cost of the dead ones or reship the amount that "had parrished"
well this PayPal con artist said they had all died (which has never happened) and opened a PayPal dispute.. we agreed that he would send at his cost all the queens back and he would get a refund.. i received a box in the mail and opened it... it was full of empty test tubes (he removed all the queens) and because a transaction was made where he shipped the goods back and it was delivered they gave him a full refund even though i filmed me opening the package and showed that he returned them empty.. so i was out $2300.00 and $2300.00 worth of ants..
I hate paypal for that policy.. but have to use it still ..

I know how you feel with PayPal cons, one guy bought some cards off me and the minute he found out their was no tracking on the package he started a claim, this was the day after he won the auction and their was no way the mail could have got to him as it takes 5 - 10 days to get there. Tried explaining to PayPal and they just don’t listen and now if you pay by PayPal it goes by registered post no exceptions

Well, this isn't a dispute with PayPal. It's with an Ebay dealer...
Chuck and Dan, I tried working this out with some civility, and will continue to do so using the recourses provided. I agree with both your assessments of the product. It's my first endeavor into the 3-D Topps world. I thought they'd be more like the Action Packed cards or some of the Topps Embossed cards. These are more like molds for plaster figurines. But, I like them as I'm on an oddball bent right now.
As far as packaging, they are really light, so the minimum would have been charged, probably $3.50 if he went through USPS, and I took that into consideration. I also agree that he's clinging to the part of unopened product, but I see where he may have an advantage there in that I not only opened the box, but opened the packages. I wasn't until I got almost halfway that I remembered he said 100 and I knew it wasn't going to get close. Sure enough it wasn't. We shall see. Ebay said he's got three days to respond and resolve this else they escalate. I'll keep you posted. And if the guy agrees to give me back $5.00, I'm fine and will move on, but I won't buy from him anymore in either case.

The issue between Ebay seller dcards and I has been settled, and had dcards not continued to fight this I would have simply let it go as a quiet victory, but he fought it to the end so I have chosen to update the thread.
I won't rehash the scenario that's posted on the first entry, but will update you to know that I communicated with Ebay and reluctantly agreed to return EVERY card to seek a full refund, rather than simply pursue a partial $5.00 refund (one third the payment), which they told me they would not have been able to force. So rather than fighting to keep several cards from my Want List and adding about 15 to my Trade List, I relented and returned the product. I had to explain that I was away from home for more than a week so they granted me an extension on my deadline to return the object else they would close the claim.
This morning I got an email from Ebay telling me that the seller was challenging my claim to a higher level and that they would get back to me within two days. Well it wasn't even two hours and they just emailed me that the seller has refunded me the money with their intervention. I'm sure they used the email correspondence we used prior to the purchase on which this claim was based. They (Ebay) ruled in my favor and closed the case. The money has posted to my PayPal. I'm a happy camper, but I have a few cards still on my Want List that few have. I won't be seeking them from dcards, though. Oh well, that's the life of a card collector.
