I found a thread on Freedom Cardboard, which lists 4x 2010 Exquisite baseball patch sets, not currently in the TCDb database. And suggests that 2010 Exqusite baseball should be a seperate release from 2010 Upper Deck. Apparently Beckett includes this set in its checklists.

This set is considered licensed. As part of the lawsuit settlement with Topps and MLBP this set was given a "license", to go with the one they had with MLBPA, and Upper Deck was allowed to liquidate any remaining inventory.
